Chinese Drywall Protection of Evidence (Evidence Protection Order EPO) - If you plan to pursue litigation to recoup the costs of your Chinese drywall remediation, then it will be necessary to collect evidence in order to prove that your home actually had Chinese drywall.
The collection of the evidence will be one of the most important aspects of your whole project. Charter Bay can perform the evidence protection portion of your remediation project. Evidence collection must be performed in strict accordance with Judge Fallon’s most current Evidence Protection Order (E.P.O). At the time of this writing, the most current E.P.O is Pretrial Order 1(I) dated 1/24/2012. Collection of evidence must also be done in accordance with your attorney’s requirements. Unfortunately, and more than once, attorneys have shared with us that contractors did not perform the EPO correctly. When it comes to collecting the evidence, there are no do-overs. Those homeowners will not know until their trials begin whether or not the mistakes made in the EPO collection will negatively effect their ability to receive compensation. Charter Bay has developed a specific set of processes to ensure all aspects of your evidence collection are done correctly. All data is then compiled in a proprietary digital portfolio, and is then distributed to all parties.
Chinese Drywall Inspections, Samples, and Testing - So, you think you may have Chinese drywall. Now what? Well, if the tell-tale signs of Chinese drywall are fairly obvious, then your next step should be to contact a Chinese drywall attorney to review your options, and get advice on what your next steps should be (we can recommend a good attorney if you need advice).
If the signs are not as conclusive, you may wish to hold off on contacting an attorney. In either case, at some point you will need to have an inspection performed, and samples taken, to help determine the extent of Chinese drywall in your home. Charter Bay can help to determine the extent of the problem, and can coordinate the collection of samples to be tested in a laboratory. There are a number of tests that can be performed, including air sample testing, bulk drywall sample testing, and actual removal of sections of drywall to specifically determine which Chinese drywall company made the drywall
Which actions are taken, and which samples are collected, will be determined by your individual situation, whether you plan to pursue litigation and will need to gather certain evidence as part of that process, and the advice of your attorney if you have retained one.
